Personal data means any information about you on the basis of which a natural person can be identified.

We process your personal data to the following extent:

a) name, surname and academic title of the user of the controller’s website https://carpatediem.sk/ (hereinafter the “data subject“);

b) address of the data subject;

c) e-mail address of the data subject;

d) phone contact of the data subject;

We process your personal data on the following legal basis:

We process personal data on the basis of your consent, which you gave on the website https://carpatediem.sk/ (hereinafter the “e-shop“) by clicking the relevant icon expressing consent to the processing of your personal data by the controller. The consent you have given is voluntary and you may withdraw it at any time.

We process your personal data for the following purposes:

a) performance of the purchase contract concluded between the controller and the data subject on the basis of a submitted order of goods;

b) sending current marketing information about new products, discounts and promotions relating to the goods and services offered; this is done by sending a newsletter (a bulletin about news and promotions) to the e-mail address you have provided;

c)  processing and handling of suggestions, complaints and questions of the customer (data subject);

d) evaluating the use of the controller’s websites (Cookies)

(hereinafter jointly referred to as the “purposes“)

You have the right to object at any time to the processing of your personal data for the above purposes.

Further information on the individual purposes, the scope and the duration of the processing of your personal data:

Ad a) The personal data provided by the data subject when purchasing through the controller’s e-shop is processed by the controller exclusively for the purpose of exercising the rights and performing the obligations arising from the distance purchase contract, to the following extent: name and surname, academic title, address, e-mail address, phone number. The provision of this data is a necessary contractual requirement and the data subject is obliged to provide it complete, correct and true. In the event of a change or the need to correct or supplement the data, the data subject is obliged to notify the controller of such change, correction or supplement without delay. After the purchase contract has been fully performed and the purchase price paid, the personal data will be stored with regard to the archiving periods under tax and commercial law and will be deleted after their expiry, unless consent has been given to its processing for other purposes. If you withdraw your consent, the controller will arrange for the immediate destruction of your personal data processed for this purpose.

Ad b) By subscribing to the newsletter or by giving consent to the use of their personal data for marketing purposes in other contact forms (e.g. when placing an order in the controller’s e-shop), the data subject consents to the processing of their personal data to the following extent: name, surname, academic title, address, e-mail address, for the purpose of informing and contacting them about new products and ongoing promotions of the controller. Consent to the processing of personal data is granted for a period of 3 years. The processing of the data subject’s personal data ends when the data subject unsubscribes from the newsletter via the link provided for this purpose in the newsletter, or when the data subject withdraws their consent to the processing of their personal data, or upon expiry of the period, whichever occurs first. If you withdraw your consent, the controller will arrange for the immediate destruction of your personal data processed for this purpose.

Ad c) By filling in the order form and giving consent, or by submitting another form that is part of a service provided by the controller, the data subject consents to the processing of their personal data to the following extent: name, surname, academic title, address, e-mail, phone, for the purpose of communicating with the customer and managing customer suggestions, complaints and questions. Consent to the processing of personal data is granted for a period of 3 years. The processing of personal data ends when the data subject withdraws their consent to the processing of their personal data, or upon expiry of the period, whichever occurs first. If you withdraw your consent, the controller will arrange for the immediate destruction of your personal data processed for this purpose.

Ad d) The controller uses Cookies on its website, which serve to make it easier for users to navigate the controller’s e-shop website. Their use does not involve the collection of any personal data and they cannot be used to collect personal data about a specific natural person. They remember the choices made by the website user and record selected information (e.g. browsing time, preferred store). Cookies are used for marketing communication and for statistical purposes. Cookies can be disabled at any time in your browser settings, which may, however, make some features of the website unavailable.

The controller uses the following types of Cookies on its e-shop websites:

  • essential Cookies: these Cookies are necessary for the operation of the controller’s e-shop websites (e.g. Cookies that allow you to log in to secure sections of the controller’s e-shop);
  • functional Cookies: these Cookies remember your choices in order to improve your user comfort. They allow the controller’s e-shop website to adapt content for you or to remember your preferences, e.g. your choice of language. The data collected by these Cookies does not personally identify you. Their use is subject to your internet browser being set to accept them; this setting is usually enabled by default in the internet browser and can be changed in the browser settings;
  • analytical Cookies: these Cookies allow us to analyse how you work with the controller’s e-shop websites, which we can use to improve and simplify the usability of the e-shop websites. The data collected by these Cookies is aggregated and anonymous;
  • social network Cookies: for some features within the controller’s e-shop websites we use a third party as a supplier, by integrating features of third-party websites – in particular social networks (Facebook, LinkedIn, Google, Twitter, YouTube), which include elements that can read and sometimes also place Cookies from these social networks on your device. As the controller, our company has no access to these Cookies; more information about the terms and the data processed is available on the websites of the operators of the respective social networks.

Are you obliged to provide us with your personal data?

The provision of personal data for the above purposes is voluntary.

However, if you do not provide personal data for the above purposes, we will not be able to accept your order and proceed with the proper performance of the purchase contract if one has been concluded, nor handle your suggestions, complaints or questions, nor send you the newsletter, and if you do not consent to Cookies, the websites you use within our e-shop may not work properly.

To whom will your personal data be disclosed?

We process your personal data for the above purposes only internally within CARPATE DIEM, s.r.o. We do not provide the personal data you have given us for one or more of the above purposes to third parties, nor do we transfer it to third countries, with the exception of our IT service providers, who need access to the information system that processes your personal data. In such a case, the IT service providers become processors and may process your personal data only on the basis of our documented contractual instructions.

Ensuring the security of your personal data:

The websites within the CARPATE DIEM, s.r.o. e-shop, as well as other computer systems, are secured by technical and organisational measures against access to, alteration of and processing of personal data by unauthorised persons, as well as against loss and destruction. Encryption is used when personal data is transferred.

Your rights regarding your personal data:

Right to withdraw consent:

You may withdraw your consent to the processing of personal data for the purposes stated above at any time with immediate effect. After you withdraw your consent, we will destroy your personal data or, if we also use it for other purposes of which we have informed you separately, we will stop using it for the above purposes for which you gave us your consent. You may withdraw your consent by sending a request electronically to the e-mail address vino@carpatediem.sk, by sending a written request to the address CARPATE DIEM, s.r.o., Nádražná 55, 900 81 Šenkvice, or by delivering a written request in person at the registered office of CARPATE DIEM, s.r.o., Nádražná 55, 900 81 Šenkvice. Withdrawal of consent does not affect the processing of your personal data carried out before its withdrawal.

Right of access to your personal data:

You have the right, upon request, to obtain from us information about what personal data we process about you for the above purposes, as well as to be provided with a copy of that personal data. However, the rights of third parties, including other persons who have provided us with personal data, may not be limited by this, and other people’s personal data may not be disclosed to you in this way.

Right to rectification or completion of your personal data:

You have the right, upon request, to have your incorrect personal data rectified and your incomplete personal data completed, with regard to the data we process about you for the above purposes. By exercising this right in a proper manner, you help us keep your personal data correct and up to date.

Right to erasure of your personal data:

You have the right, upon request, to ask for the erasure of your personal data (and only yours), where the purpose of its processing described above has ended, where legislation requires your personal data to be erased, or where your personal data is being processed unlawfully.

Right to restriction of processing of your personal data:

You have the right, upon request, to have your personal data blocked (restriction of the processing of your personal data to mere storage of your personal data; during the blocking we may not carry out any other operations with it), but only in the following cases:

a)    restriction of the processing of your personal data while its accuracy is being verified;

b)    where your personal data is being processed unlawfully and, at the same time, you request only the restriction of its processing (storage only) instead of the erasure of your personal data;

c)    where you need your personal data to establish, exercise or defend legal claims.

Right to portability of your personal data:

You have the right, upon request, to receive the personal data we process about you for the above purposes in a structured, commonly used and machine-readable format, and you have the right to request the transfer of this personal data to another controller, where technically feasible. However, the rights of third parties may not be limited by this.

Right to object to the processing of your personal data for the above purposes:

You have the right to object at any time to the processing of your personal data for one or more of the above purposes, by sending a request electronically to the e-mail address vino@carpatediem.sk, by sending a written request to the address CARPATE DIEM, s.r.o., Nádražná 55, 900 81 Šenkvice, or by delivering a written request in person at the registered office of CARPATE DIEM, s.r.o., Nádražná 55, 900 81 Šenkvice.  Upon receipt of your objection, we will destroy your personal data or, if we also use it for other purposes of which we have informed you separately, we will stop using it for the purposes to which you have objected. Your objections do not affect the processing of your personal data carried out before their receipt.

How you can exercise all your rights regarding your personal data:

You may exercise your rights by sending a request electronically to the e-mail address vino@carpatediem.sk, by sending a written request to the address CARPATE DIEM, s.r.o., Nádražná 55, 900 81 Šenkvice, or by delivering a written request in person at the registered office of CARPATE DIEM, s.r.o., Nádražná 55, 900 81 Šenkvice.

When you make a request concerning your personal data, we are obliged to verify your identity to make sure that it is really you who is exercising the rights to your personal data. We will verify your identity by inspecting your photo ID when you deliver your written request in person; in the case of a postal or electronic request, if in doubt, we will ask you for further information in order to reliably establish your identity.

We will respond to your request concerning the processing of personal data without undue delay, and in any event within one month of its receipt. In special cases, we may extend this period by a further two months, but we will always inform you of the reasons for the extension within one month of receiving the request.

We respond to your requests free of charge, but if your requests are unreasonable, manifestly unfounded or frequently repeated, we may charge you a reasonable administrative fee for handling them.

You have the right to lodge a complaint with the supervisory authority (Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 820 07 Bratislava 27) if you believe that the processing of your personal data is contrary to this information or to applicable legislation. Before doing so, however, we recommend that you contact our appointed person, who is ready to resolve any concerns you may have to your satisfaction.

In any case, you are obliged to provide us only with personal data that is correct, complete and up to date. If you are under 16 years of age, you may provide your personal data only with the express consent of your legal guardian.
